According to the lawsuit, the defendant failed to pay employees for all the time they were under the employer’s control, including the time employees spent submitting to mandatory COVID-19 screening before clocking in for the day. If time worked off the clock did not qualify for overtime premium payment, defendant is alleged to have failed to pay the minimum wage and overtime wages for that time.
The Private Attorneys General Act (PAGA) allows the State of California to enforce state labor laws through an employee suing under the PAGA who acts as the proxy or agent of the state’s labor law enforcement agencies. A PAGA action aims to recover civil penalties, not damages or restitution, to protect the public by deputizing citizens as private attorneys general to enforce the Labor Code.
